Abstract

Sedan 2002 har alla veterinärer i Sverige anmälningsplikt vid misstanke om brott mot djurskyddslagen. Syftet med detta arbete var att undersöka vilken inställning veterinärer anställda av Jordbruksverket inom Distriktsveterinärerna hade till anmälningsplikten, och mer specifikt vilka faktorer som påverkar denna inställning. I uppsatsen tittar jag även på några av de etiska resonemang som underbygger veterinärernas ställningstagande, framför allt vad gäller hur man balanserar djurets och djurägarens intressen.

Undersökningen använde sig av kvalitativ metod och är utförd genom djupintervjuer med tio distriktsveterinärer på olika orter i Sverige. Tillvägagångssättet betonar beskrivning och tolkning snarare än analys och mätning och valdes då denna studie saknar föregångare; det saknas material att formulera hypoteser utifrån.

Resultatet visade på att anmälningsplikten ansågs vara bra och ett viktigt verktyg, men ett verktyg som bara fick användas efter noggrann eftertanke och bedömning av konsekvenserna. Fem av tio av de intervjuade veterinärerna hade aldrig anmält något fall, och en anmälan sågs även som ett sätt att straffa djurägare man inte upplevde sig kunna nå fram till på annat sätt. Man betonade ofta att anmälningsplikten innebar väldigt svåra överväganden, åtta av tio upplevde att det fanns en konflikt mellan den vårdande och den kontrollerande aspekten av den veterinära yrkesrollen. En rad faktorer vägdes samman när man avgjorde hur man ska hantera fall där djur for eller riskerade fara illa. Den enskilt viktigaste faktorn var djurägaren och dennes relation till och kommunikation med veterinären. Ingen av de intervjuade veterinärerna skulle tvekat att anmäla grava fall av djurlidande, men om det inte är ett solklart lidande försökte man hitta alternativ till att anmäla och arbetade sig runt hinder som djurägare och lagstiftning. Ofta ansåg man att man därigenom kunde göra en större insats för djurskyddet. Vilka faktorer och alternativa handlingssätt som fick vikt berodde bland annat på hur veterinären såg på sin egen roll, hur man balanserade djurets och djurägarens intressen, relationen med länsstyrelsen och samspelet med kollegorna. Informanterna försökte sätta djurets intressen i första rummet, men tog i realiteten oftast större hänsyn till ägarens. Många gjorde en distinktion mellan patienten; djuret och kunden; djurägaren och menade att veterinären har skyldigheter gentemot båda, men ska fungera som en advokat för djurets intressen om dessa inte uppfylls av ägaren.

Anmälningsplikten är i sin nuvarande formulering mycket omfattande och en omformulering enligt utredarnas förslag i utredningen ”Ny djurskyddslag” där anmälningsplikten träder in först om bristerna inte är lindriga eller omgående kan rättas till skulle underlätta veterinärernas situation. Denna uppsats visar på att distriktsveterinärer i dagsläget utför mycket obetalt merarbete för att skapa lösningar man anser innebär större förbättringar för djurskyddet än vad en anmälan skulle göra.

Since 2002, all veterinarians working in Sweden have an obligation to report cases of suspected violations of the Animal Welfare legislation. The aim of this paper was to investigate the attitude veterinarians employed in the District Veterinarians had to the notification obligation, and more specifically what factors affected this attitude. The thesis also looks at some of the ethical reasoning underpinning the veterinarian´s position, particularly in terms of how to balance the animal´s and the animal's owner´s interests.

The study used a qualitative method and is carried out through in-depth interviews with ten veterinarians at various locations in Sweden. The approach emphasizes description and interpretation rather than analysis and measurement, and was chosen as the study is without precedent; there´s no material to formulate a hypotheses from.

The result showed that the notification obligation was considered to be an important tool, but a tool that could only be used after careful consideration and assessment of the consequences. Five out of ten of those interviewed had never reported any case, and the notification was also seen as a way to punish owners the veterinarians felt they were not able to reach otherwise. It is often stressed that the obligation notification entailed very difficult decisions, and eight out of ten veterinarians felt that there was a conflict between the caring and the controlling aspect of their professional role. A number of factors were weighed together when decided how to deal with cases of suspected violation of the legislation. The single most important factor was the animal owner and his or her relationship to and communication with the veterinarian. None of the interviewed veterinarians would have hesitated to report severe cases of animal suffering, but if the suffering was not severe the veterinarians attempted to find alternatives routes and worked his or her way around obstacles like animal owners and legislation. The veterinarians often considered that they thereby could make a greater contribution to animal welfare. What factors and alternative approaches that got weight was partly due to how the veterinarian looked at his or her own role, how they balanced the animal and the animal's owner interests, the relationship with the provincial government and the interaction with colleagues. The informants tried to put the animal's interests first, but in reality usually took greater account of the owners. Many made a distinction between the patient; the animal and the customer; the animal owner and believed that the veterinarian has obligations to both, but should act as an advocate for animals interests if these are not properly met by the owner.

The notification obligation is in its present formulation very extensive and a reformulation where the notification obligation should intervene only if the deficiencies are not mild or can be promptly corrected would facilitate the veterinarian´s situation. This paper shows that veterinarians in the current situation performs much unpaid extra work to create solutions one consider leads to greater improvements in animal welfare than a notification would do.
